Responsibilities
It is the responsibility of the Architectural Control Committee (ACC) to approve all construction and development in the Estates of Shady Hollow. Their job is to ensure that plans meet the CC&R's. If you are contemplating a change to your residence, take a look at the ACC FAQ's to get an understanding of what is expected by the ACC in your application for a change to the exterior of your dwelling or grounds.

In general, you must submit an application to the ACC that includes the following (there are no special forms):
A letter signed by the homeowner which states the purpose of the application (e.g. construct a swimming pool, build a new fence, storage shed, etc.). A copy of your property plat showing the location of the changes to the property. Details about the changes to the property (see FAQ's below), including drawings where needed, and estimated start and completion dates. Applications do not have to include professional drawings. Your hand drawn sketch(es) with the necessary information will usually be sufficient.
If the ACC needs additional information regarding your application, they will contact you. They may want to visit your property to get a better understanding of the changes being requested.
The ACC will notify you by mail with the results of their review.
It is the goal of the ACC to make the application process as painless as possible. If you wish, you can call an ACC member prior to submitting an application to ensure that you have included everything needed for review.
Note: Above ground pools are prohibited.
Show the location of the pool on the plat, so that the ACC can confirm setback requirements.
Show the location of pool equipment and describe how it will be screened (must be screened from public view).
Show the location of required safety/security fencing, and indicate that all gates will have self-closing latches. (Self-closing latches are the responsibility of the homeowner, not the contractor.)
Compliance with City of Austin and Travis County construction codes is required. Indicate in your cover letter or drawings, or within documentation provided by your selected contractor that this is understood.
Temporary structures for the purpose of lawn storage equipment are permitted; however, approval by the ACC is required.
Temporary structures must meet CC&R requirements. e.g, setback of 10 ft. or greater, construction material must be wood or other approved durable material (no tin or galvanized metal), and the roof must be shingled. The color of the exterior and roof shingles should match existing house. (Although it is recognized that exact matches may not be possible)
Details should include a description of the shed, its use (lawn equipment, swimming pool equipment, etc.), size and materials of construction (to confirm that the requirements in the previous paragraph will be met.)
Workshops are permitted as storage sheds. See the above FAQ for details. Workshops as large as 500 sq. ft. have been approved in the past.
Structures such as green houses and bird aviaries do require ACC approval.
Details should include a complete description of the structure, including its size, type, finish, etc. It's recommended that a drawing or sketch of the structure be included.
Details should also include a description of the structure's visibility relative to neighboring views (screened by trees/shrubs etc.).
Patio covers require ACC approval. The roof pitch must match that of the residence, and it must have the same type, quality, and color shingles as the residence. (It is recognized that color fading and dye lots may not permit an exact match. As close a match as can be reasonably achieved is acceptable.)
Details should include a description of the patio cover, including its size and the materials to be used. There should be enough information to confirm that the requirements in the above paragraph will be met.
Driveway extensions do require ACC approval.
Show both the existing and new driveways on the plat submitted with the application. Details should include the material being used for the driveway (the CC&R's require that driveways be constructed of a concrete based product).
Include the type, diameter, and estimated age of each tree to be removed with your application. You may be required to plant new trees to compensate for established hardwood trees being cut down.
Fences do require ACC approval. Picket type fencing is the minimum standard within the ESH, no chain link perimeter fencing is allowed.
The property lines and fence lines should be shown on the plat submitted with the application. Details should include the height of the fence and the material to be used.
Replacement of an existing fence (because of deterioration or damage) with one of the same size and materials does not need approval.
Kids play equipment within a ‘reasonable size’ is considered ‘temporary’ and does not require ACC approval.
Minor changes and improvements to your landscaping do not require ACC approval. However, extensive landscape modifications or improvements may warrant an approval.
If you are uncertain as to what constitutes "extensive", it is best to present a sketch to the ACC to get an opinion.
Normally the ACC meets once every month during the evening hours. If an application is submitted 2 or more days prior to the meeting, it will be reviewed at the meeting and the ACC will mail you a response within 2 - 7 days after the meeting.
If there is insufficient information in the application, this may cause the time period to increase, depending on how quickly the ACC can get in touch with you and get their questions resolved. If you would like for them to call you with questions during their meeting, include your phone number and a statement to that effect with your application.
